Terms of service
The legal terms that govern your use of Capseta.
Welcome to Capseta. These Terms of Service ("Terms") govern your access to and use of Capseta's website, web application, and services (collectively, the "Service"). The Service is provided by Schick Creative LLC ("Capseta," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use the Service.
Account terms
Eligibility
You must be at least 13 years old to use Capseta. By using the Service, you represent that you meet this age requirement and have the authority to enter into these Terms.
Account creation
To use Capseta, you must create an account by providing your name and email address. You're responsible for keeping your account credentials secure and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at Hello@Capseta.app.
Account responsibility
You're responsible for all content stored in your account and all actions taken using your account. You must not share your account with others, use another person's account without permission, or create multiple accounts to circumvent service limitations.
Acceptable use policy
When using Capseta, you agree not to:
- Violate any laws, regulations, or third-party rights.
- Upload malicious code, viruses, or malware.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use automated systems (bots, scrapers) to access the Service without permission.
- Abuse or harass other users, our team, or any third parties.
- Use the Service for any commercial purpose without our written consent.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Store or share illegal content, copyrighted material you don't own, or content that violates others' rights.
- Interfere with or disrupt the Service or its infrastructure.
We reserve the right to suspend or terminate accounts that violate these terms.
Content ownership and copyright
Your content
You retain all ownership rights to the recipes, photos, notes, meal plans, and other content you store in Capseta ("Your Content"). We don't claim any ownership over Your Content. By using the Service, you grant us a limited license to store, display, and process Your Content solely for the purpose of providing the Service to you.
Copyright responsibility
When importing recipes from cookbooks, websites, or other sources, you're responsible for respecting copyright law. Capseta is designed for personal recipe organization — not for bulk distribution of copyrighted content. We've built privacy controls and sharing limits to help users comply with copyright law, but you're ultimately responsible for how you use the Service.
Our content
All content published by Capseta — including articles, guides, documentation, design elements, logos, and software code — is owned by Schick Creative LLC and protected by copyright. You may not copy, reproduce, or distribute our content without permission.
Service terms
Service availability
Capseta is currently in public beta and provided free of charge. We strive to maintain high availability but make no guarantees about uptime or performance during the beta period. The Service may be temporarily unavailable for maintenance, upgrades, or due to technical issues beyond our control.
Beta period and future paid product
Capseta is free to use during the beta period. After beta, ongoing access to new recipe imports and other paid features will require a subscription. Pricing and exact terms will be communicated in advance of any change so you can decide whether to continue.
Recipes you imported during the beta will remain accessible to you afterward, even if you choose not to subscribe. You will always be able to view, search, cook from, export, and share the recipes you imported during beta — this commitment carries forward through the paid product launch.
Subscriptions and billing
When the paid product launches, subscriptions are billed annually. One plan covers your whole household, up to four people; current pricing is on our Pricing page. Prices are shown and charged in your local currency with any applicable tax included.
Payments are processed by Paddle.com, our authorized reseller and Merchant of Record. Paddle handles billing, tax, and receipts, and its name may appear on your bank or card statement.
Subscriptions renew automatically at the end of each term unless cancelled, and we send a renewal reminder about one week beforehand. You can cancel anytime from your account or Paddle's customer portal; when you cancel, you keep access through the end of the term you've paid for.
If a subscription ends, your account becomes read-only: your recipes are retained, you keep access to view, search, cook from, export, and share them, and full editing returns when you resubscribe. The 25-recipe trial applies to a new account evaluating Capseta before paying, and is not a free plan that a cancelled account returns to. You can export all of your data at any time, and beta-imported recipes remain accessible as described above.
Advertising
Capseta does not currently include advertising. If we introduce advertising in the future, we'll update these Terms and notify you in advance of any change. We will not sell your personal data or recipes regardless of any future revenue model.
Changes to service
We may modify, suspend, or discontinue any part of the Service at any time. We'll provide reasonable notice for significant changes that negatively affect functionality, but we're not obligated to maintain any specific feature indefinitely.
Data export
You can export your recipes at any time. We recommend periodic backups. If we discontinue the Service, we'll provide at least 90 days' notice and tools to export your data.
Disclaimers and limitations
No warranties
Capseta is provided "as is" without warranties of any kind, express or implied. We don't guarantee that the Service will be error-free, secure, or uninterrupted. We don't warrant the accuracy of AI-extracted recipe data, and users should review all imported recipes for errors.
Limitation of liability
To the maximum extent permitted by law, Schick Creative LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, lost profits, or business interruption. Our total liability for any claims related to the Service is limited to US$100 or the amount you paid us in the past 12 months, whichever is lower.
Not legal or nutritional advice
Information on Capseta about copyright law, food safety, nutrition, or cooking techniques is for informational purposes only. We're not lawyers, nutritionists, or certified food safety experts. Consult appropriate professionals for legal, medical, or dietary advice.
Termination
By you
You can delete your account at any time through Settings → Delete Account. Deletion is permanent and irreversible. We'll delete your recipes, personal data, and uploaded images from our systems and third-party services.
By us
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the Service in ways that harm other users or our infrastructure. We'll provide notice when reasonably possible, but we reserve the right to terminate immediately for severe violations (e.g., security threats, illegal activity).
Dispute resolution
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Massachusetts.
Contact first
Before pursuing formal legal action, please contact us at Legal@Capseta.app to resolve the issue. Most disputes can be resolved through conversation.
Changes to these terms
We may update these Terms from time to time. When we make significant changes, we'll notify you via email or through a prominent notice in the Service. We'll also update the "Effective Date" at the top of this page.
Your continued use of Capseta after changes to these Terms means you accept the updated terms. If you don't agree to the changes, you should stop using the Service and delete your account.
General terms
Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Capseta regarding the Service. They supersede any prior agreements or understandings.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No waiver
Our failure to enforce any provision of these Terms doesn't waive our right to enforce it later. Any waiver must be in writing and signed by an authorized representative of Capseta.
